These Terms and Conditions (“Terms”) govern your use of holistico.ca (the “Site”) and any program, service, product, or resource you buy, download, or access from Holistico Inc. (“Holistico,” “we,” “us”). Please read them carefully. By using the Site or buying from us, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
1. Definitions
“Content” means everything on the Site or provided by us, including text, blog posts, graphics, photos, audio, videos, guides, e-books, worksheets, templates, emails, and program materials.
“Programs, Services, and Products” means our coaching and nutrition services, client packages, programs, labs, memberships, subscriptions, courses, e-books, downloads, and any other offering we sell or provide.
“You” means anyone who visits the Site or buys from us.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to use the Site or buy from us.
3. Not medical advice
Katie McKersie is a Registered Holistic Nutritionist (RHN) and Functional Diagnostic Nutrition Practitioner (FDN-P). We are not medical doctors, dietitians, pharmacists, or other licensed health professionals, and we do not diagnose, treat, cure, or prevent any disease.
Content on the Site, on social media, and in our emails is for general education and information only. It is not medical advice and is not a substitute for care from your doctor or other qualified health professional.
Before changing your diet, supplements, exercise, medications, or medical treatment, talk to your doctor, especially if you are pregnant, breastfeeding, taking medication, or managing a health condition. Never stop or change prescribed medication without your doctor’s guidance. Functional lab testing is educational and is not used to diagnose disease.
If you have a medical emergency, call 911 or go to the nearest emergency department.
4. Client services
If you become a client, you will also sign a client agreement and intake consent through our client platform, Practice Better. If anything in that agreement conflicts with these Terms, the client agreement applies to your services.
5. Results and testimonials
Testimonials, transformation photos, client stories, and examples on the Site reflect individual experiences. They are not typical results or guarantees. Everyone’s body, history, and circumstances are different, and results depend on many factors, including how closely recommendations are followed. Testimonials are shared only with the client’s written permission, as described in our Privacy Policy.
6. Affiliate links
Some links on the Site are affiliate links. If you buy through them, we may earn a commission at no extra cost to you. We only recommend products we use or believe in. Purchases from other companies are governed by their own terms.
7. Using the Site
You agree to use the Site only for lawful purposes. You agree not to:

Break any applicable law or regulation

Post or send anything abusive, threatening, harassing, hateful, defamatory, obscene, or discriminatory

Send spam or unsolicited advertising through the Site

Post content, photos, or materials that you do not own or have permission to use

Promote or sell your own or anyone else’s products or services through the Site

Copy, scrape, or reproduce our Content in a way that infringes our rights

Try to interfere with the Site’s security or operation
8. Our intellectual property
All Content is owned by Holistico Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws.
When you buy or download something from us, you receive a limited, personal, non-transferable license to use it for your own personal, non-commercial use. You may not copy, resell, share, distribute, post publicly, modify, or use our Content for commercial purposes, including in your own practice or business, without our written permission.
You are welcome to share links to the Site and our public posts for personal purposes, as long as you credit Holistico and link back to the original. You may not present our Content as your own or suggest that you are affiliated with Holistico or Katie McKersie.

9. Things you send us
If you post a comment, review, or other public submission, you confirm that it is yours to share and that it does not break these Terms. You give us a non-exclusive, royalty-free license to display it on the Site and our channels. We may remove submissions at any time.
This license does not apply to health information you share with us as a client, or to testimonials, photos, or recordings. Those are handled only as described in our Privacy Policy and your signed consent.
10. Purchases and payment
Prices are listed in the currency shown at checkout and may change at any time before you buy. Payments are processed securely by our payment processors, including Stripe and Practice Better. You will receive an electronic receipt.
If you buy a payment plan, membership, or subscription, you authorize us to charge your payment method automatically on each billing date until the plan is paid in full or you cancel. You can cancel a membership or subscription by emailing hello@consultholistico.com before your next billing date; cancellation stops future charges but does not refund past charges.
If a payment fails, we may pause or end your access until payment is made. For payment plans, you remain responsible for the full purchase price.
11. Refunds
Because our services involve personalized time, expertise, and lab processing, all sales are final and we do not offer refunds on:

Coaching sessions, packages, and programs once purchased

Functional lab tests once the kit has been ordered or shipped

E-books, downloads, and digital products once accessed

Memberships and subscriptions for billing periods already charged
This does not limit any rights you have under applicable consumer protection law. If you have a concern, please email hello@consultholistico.com. We want to make it right where we reasonably can.
12. Third-party sites
The Site links to websites we do not control, including Practice Better, laboratories, social media platforms, and affiliate merchants. We are not responsible for their content, products, or privacy practices. Please review their terms and policies.
13. Accuracy of information
We work to keep the Site accurate and current, but we do not guarantee that all Content is complete, accurate, or up to date. Nutrition research changes, and Content may be updated or removed at any time without notice.
14. Limitation of liability
To the fullest extent permitted by law:

The Site and our Content are provided “as is,” without warranties of any kind.

Holistico Inc. and its owners, contractors, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our Programs, Services, and Products.

Our total liability for any claim is limited to the amount you paid us for the specific product or service the claim relates to.
You are responsible for your own health decisions, including whether to follow any recommendation and whether to consult your doctor first. Nothing in these Terms limits liability that cannot be limited by law.
15. Indemnity
You agree to cover any claims, losses, or costs, including reasonable legal fees, that result from your breach of these Terms or your misuse of the Site or our Content.
16. Ending access
We may suspend or end your access to the Site or any Program, Service, or Product if you breach these Terms, misuse our Content, or behave abusively toward us or other clients. If we end access because of your breach, no refund is owed.
17. Resolving disputes
If you have a concern, please email hello@consultholistico.com first. Most issues can be resolved directly. If we cannot resolve it informally, either of us may propose mediation or arbitration, but neither is required unless we both agree in writing at the time.
18. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Subject to any consumer protection rights you have where you live, disputes will be handled in the courts of Alberta, in Calgary.
19. Changes to these Terms
We may update these Terms from time to time. The date at the top shows the latest version. Changes apply from the date they are posted, but they do not change the terms of a purchase you already made.
20. General
These Terms, our Privacy Policy, and any client agreement you sign are the entire agreement between you and us about the Site and our Programs, Services, and Products. If any part of these Terms is found unenforceable, the rest still applies. If we do not enforce a term right away, we still have the right to enforce it later.
